> Rules of conduct for using the Birdeye Peak platform, services, data and APIs.

> [!NOTE]
>
> This document is provided by Wings Lab Pte. Ltd., the operator of Birdeye Peak. **Last updated:** 13 October 2026.

## 1. STATUS AND SCOPE

### 1.1 This Policy is binding

This Acceptable Use Policy (this "**AUP**") is a policy of **Wings Lab Pte. Ltd.** (the "**Company**", "**Birdeye**", "**we**", “**our**”, "**us**") and applies to every User of the Platform, the App, the Services and the Content, including all use of the Birdeye Peak Data APIs.

It is incorporated into and forms part of the [Terms of Use](https://peak-docs.birdeye.so/docs/resources/legal/product-terms-of-use.md) (the "**Terms**"). Section 4A(x) of the Terms (Restrictions - Violation of Policies) prohibits accessing or using the Platform, or any Service or Content provided therein, to violate or attempt to violate any policy of the Company. A breach of this AUP is therefore a breach of the Terms, and entitles us to exercise any remedy available to us under Section 4 or Section 14B of the Terms. Capitalised terms not defined here have the meanings given in the Terms.

### 1.2 Relationship to the Terms

This AUP supplements the Terms; it does not replace, narrow or exhaust it. Conduct may breach the Terms without being listed here. Where this AUP and the Terms address the same conduct, both apply, and the Terms prevail in the event of any inconsistency.

### 1.3 Not exhaustive

The examples below are illustrative. We may treat conduct as a breach where it is plainly contrary to the purpose of a prohibition, even if it is not expressly listed.

### 1.4 Terms used in this AUP

The following terms are used in this AUP and, to the extent they are not defined in the Terms, have the meanings given below:

"**AI Feature**" means the Assistant, any Agent, and any other machine-learning feature of the Services through which AI Output or Agent Output is generated.

"**API Key**" has the meaning given in Section 3D of the Terms (Birdeye Peak Data APIs).

"**Compute Units**" has the meaning given in Section 5D of the Terms, and "Compute Unit" means any one of them.

"**Digital Wallet**" has the meaning given in Section 2A of the Terms.

"**Seat**" has the meaning given in Section 5B of the Terms (Payment, Gas Fees and Taxes).

### 1.5 Your responsibility for others

You are responsible for all activity conducted through your User Account, API Keys, Seats and Digital Wallet connections, and for the acts and omissions of any person or process you permit to use your access, including any employee, contractor, agent, service provider, affiliate, bot or automated agent. Every prohibition in this AUP that applies to you applies equally to any such person or process, and a breach by them is a breach by you.

## 2. LAWFUL USE

You must not use the Platform, any Service or any Content:

**2.1** in furtherance of, or in a manner that facilitates, any criminal offence — including fraud, deception, theft, extortion, money laundering, terrorist financing, proliferation financing, sanctions evasion, tax evasion, bribery, or the sale of controlled substances, weapons or stolen data;

**2.2** in breach of any sanctions, export control or trade restriction applicable to you or to us, or from, in or on behalf of any of the Restricted Jurisdictions, or by or on behalf of any person that is subject to sanctions or otherwise designated on any list of prohibited or restricted parties, including the lists maintained by the United Nations Security Council, the Singaporean government, the United Kingdom government, the U.S. Government (including the Specially Designated Nationals List and Foreign Sanctions Evaders List of the U.S. Department of the Treasury and the Entity List of the U.S. Department of Commerce), the European Union or its Member States, or any other applicable government authority (each a “**Restricted Party**”);

**2.3** in breach of any law, regulation, licensing requirement or regulatory obligation applicable to you, including any securities, commodities, derivatives, market conduct, consumer protection, data protection or tax requirement;

**2.4** where your access or use is prohibited in your jurisdiction, or by using a VPN, proxy, relay or other means to conceal or misrepresent your location in order to circumvent a geographic restriction; or

**2.5** in a manner that breaches the terms of any third-party service you access through, or connect to, the Platform, including any wallet provider, RPC provider, decentralised exchange, aggregator, bridge, oracle or data source. You are responsible for your use of those services, and we are not a party to your relationship with them.

## 3. MARKET INTEGRITY

You must not use the Platform, any Service, any Content or any other functionality to plan, coordinate, execute, conceal or promote:

**3.1** market manipulation, including spoofing, layering, quote stuffing, momentum ignition, ramping, marking the close, or wash trading and self-trading;

**3.2** artificial inflation of volume, liquidity, holder counts, transaction counts or any other observable metric;

**3.3** pump-and-dump, rug-pull, honeypot or exit-scam schemes, or the coordinated promotion of a token ahead of a coordinated disposal;

**3.4** insider dealing or the unlawful use or disclosure of inside or material non-public information;

**3.5** the unregistered or unlawful offer, sale, promotion or distribution of any security, fund interest or regulated financial product;

**3.6** extractable-value strategies directed at other Users, including sandwich attacks, front-running or back-running another User's pending transaction, transaction-ordering manipulation, or the abuse of priority fees, private order flow or latency advantages obtained through or in connection with the Platform; or

**3.7** the submission, listing or promotion of false, misleading or counterfeit token metadata, including any name, symbol, logo, description, website, social link or verification claim.

## 4. INTEGRITY OF RISK INDICATORS AND THE SECURITY CHECK

Security Check outputs are determined through automated means. Their usefulness depends on nobody manipulating them and nobody overstating them.

**4.1 No Manipulation.** You must not take any action, or advise, assist or procure any person to take any action, for the purpose or with the effect of manipulating, evading or artificially satisfying any Risk Indicator, Severity Classification or Outcome State so as to create a false or misleading appearance of safety, decentralisation, holder dispersion, liquidity permanence or absence of control.

**4.2 No Misrepresentation.** You must not represent, or permit any person to represent, that a Risk Indicator, Severity Classification, Outcome State or Security Check result constitutes a security audit, code review, formal verification, certification, endorsement, approval or investment recommendation by Birdeye. In particular, you must not represent an Outcome State of "Pass", or the absence of a flag, as a clearance or as evidence that a token, contract or address is safe or legitimate.

**4.3 Not a Compliance Tool.** The Services are not designed, tested or provided as a know-your-transaction, transaction-monitoring, anti-money-laundering, counter-terrorist-financing, sanctions-screening or fraud-detection system, and must not be used as one, or as the basis for any suspicious activity report, de-risking or account-closure decision. You remain solely responsible for selecting and validating fit-for-purpose compliance tooling.

## 5. DATA, CONTENT AND INTELLECTUAL PROPERTY

**5.1** You must not use any robot, spider, crawler, scraper, headless browser, automated script or other automated means to access, monitor, index, cache, copy, harvest, systematically download or otherwise extract any part of the Services or Birdeye Peak Data, except through the Birdeye Peak Data APIs within your applicable entitlements and rate limits.

**5.2** You must not construct, accumulate or maintain a persistent, cumulative or historical store of Birdeye Peak Data, or reconstruct any dataset in whole or in substantial part, beyond the caching expressly permitted in the API documentation.

**5.3** You must not redistribute, resell, sublicense, syndicate, publish or otherwise make Birdeye Peak Data available to any third party, or use it as an input to any product or service made available to any third party, except under a written licence from us permitting that use.

**5.4** You must not use Birdeye Peak Data or any Service output to train, fine-tune, distil, ground, evaluate, benchmark, augment or retrieve into any machine-learning model, large language model, artificial-intelligence system, agent, quantitative model, index or dataset, in each case without our prior express written consent.

**5.5** You must not use Birdeye Peak Data, Research, or any index or reference price as a benchmark or pricing source for, or to determine any amount payable under or the value of, any financial instrument, fund, derivative or contract, or as an oracle, valuation, collateral, margin, liquidation or settlement input, without a separate written licence.

**5.6** You must not remove, obscure or alter any attribution, watermark, source credit, timestamp or disclaimer, or present Birdeye Peak Data in a way that misstates its source, currency, methodology or completeness.

**5.7** You must not operate, publish or promote any unofficial client, mirror, proxy, wrapper, or framed or embedded copy of the Platform, or any browser extension or overlay that injects into, alters, or re-presents the Platform or Birdeye Peak Data, in each case without our prior written consent.

## 6. BIRDEYE PEAK DATA APIs

**6.1** API Keys are confidential and licensed to you alone. You must not embed an API Key in client-side code, a public repository, a mobile application, a browser extension or any artefact accessible to third parties, and you are responsible for all calls made with your keys.

**6.2** You must not exceed applicable rate limits, or evade them by rotating keys, IP addresses or accounts, by distributing calls, or by creating multiple accounts.

**6.3** You must not use the APIs to supply, populate or power any third-party-facing product without a written licence permitting that use.

**6.4** You must notify us at [support.peak@birdeye.so](mailto:support.peak@birdeye.so) without undue delay after becoming aware that an API Key has been disclosed, compromised, lost or used without your authorisation, and you must promptly rotate the affected key. This does not limit your responsibility under Section 6.1 for all calls made with your keys.

**6.5** Access to the Birdeye Peak Data APIs is provided on a fair-use basis and is subject to the rate limits, request quotas, concurrency limits, Compute Unit allocations, Seat allocations and other usage thresholds published in the API documentation or set out in your subscription or entitlement. We may set, vary, reallocate or withdraw those thresholds at any time, including to protect the stability, security or availability of the Platform. Except to the extent expressly permitted by a written agreement between you and Birdeye, the Birdeye Peak Data APIs are provided without any uptime, availability, latency, throughput, data-freshness, coverage or support commitment.

**6.6** Where your usage exceeds an applicable threshold, we may throttle, queue, delay or reject calls, temporarily suspend the affected API Key, feature or account, or reduce or reallocate your allocation, in each case automatically and without prior notice. Where your subscription provides for overage, we may instead charge the excess as Overage Charges in accordance with Section 5D of the Terms. A temporary suspension under this Section is not a termination of the Terms, and access is ordinarily restored at the start of the next usage cycle or once your usage returns within the applicable threshold.

## 7. BIRDEYE PEAK ASSISTANT AND AI FEATURES

Section 4A of the Terms (Restrictions) contains a list of prohibited uses of the Platform, the Services and the Content, including the Assistant. This Section restates and expands that list; the prohibitions in both are cumulative and are to be read together.

**7.1** You must not attempt to extract, infer, elicit or reconstruct any system prompt, instruction, guardrail, model weight, training data, index or scoring methodology or threshold, or the User Content, credentials or data of any other User.

**7.2** You must not use the Assistant to circumvent any entitlement, Seat limit, rate limit, paywall, geographic restriction or access control, or to obtain data outside the scope of your subscription.

**7.3** You must not use the Assistant to extract Birdeye Peak Data systematically or in bulk. Sections 5.1 and 5.2 apply to Assistant usage in the same way as to the APIs.

**7.4** You must not jailbreak the Assistant, engage in adversarial prompting, or attempt prompt injection, including without limitation, by deploying tokens, contracts, metadata, transaction memos or content designed to manipulate the behaviour of the Assistant or of any other User's session.

**7.5** You must not use AI Output to make or implement any automated decision producing legal effects for, or otherwise significantly affecting, any individual.

**7.6** You must not present AI Output to any third party as verified fact, as advice or a statement of Birdeye, or without disclosing that it was machine-generated where the context would otherwise mislead.

**7.7** Access to the Assistant and any other AI Feature is provided on a fair-use basis and is subject to usage thresholds, which may include limits on prompts, messages, sessions, tokens, Compute Units, concurrent requests or Seats over a given period. We may set, vary, reallocate or withdraw those thresholds at any time, and different thresholds may apply to different subscription levels.

**7.8** Where your usage exceeds an applicable threshold, or where your usage pattern is materially inconsistent with normal individual use, we may throttle or queue your requests, reduce response length or model capability, or temporarily suspend your access to the Assistant, in each case automatically and without prior notice. A temporary suspension under this Section is not a termination of the Terms, and access is ordinarily restored at the start of the next usage cycle or once your usage returns within the applicable threshold.

**7.9** Seats are licensed as set out in Section 5B of the Terms (Payment, Gas Fees and Taxes). You must not share Assistant credentials or sessions, operate the Assistant through shared, pooled or rotating accounts, run scripted, batched or parallel prompting, or otherwise use the Assistant in a manner designed to obtain more capacity than your entitlement provides.

## 8. PROGRESS TRACKING AND REWARDS

**8.1** You must not create or operate multiple accounts, or use Sybil addresses, bots, scripts, emulators, automation or click farms, in order to obtain, inflate or accelerate points, tiers, statuses, leaderboard positions or Intangible Rewards.

**8.2** You must not collude with other Users, exploit a defect, or use any method not expressly authorised by us to influence a Progress Tracking outcome.

**8.3** You must not sell, buy, transfer, rent or offer to transfer any account, username, points, tier, status or Intangible Reward.

**8.4** You must not offer, advertise or provide account-boosting, resource-farming, botting or similar services to any other person, whether or not in exchange for payment.

**8.5** Where we operate a referral, affiliate or ambassador programme, you must not use self-referrals, fabricated, incentivised or duplicate sign-ups, or misleading claims about the Platform, any Intangible Reward or any expected return, in order to earn or increase a referral benefit. We may withhold, reverse or claw back any benefit obtained in breach of this Section 8.

**8.6** We may reset, adjust, suspend or withdraw points, tiers, statuses and Intangible Rewards where we reasonably believe this Section 8 has been breached.

## 9. CONDUCT TOWARDS OTHER PEOPLE

**9.1 Harassment and Abuse.** You must not harass, threaten, stalk, bully, intimidate or abuse any person, or post content that is defamatory, obscene, hateful, or that incites violence or discrimination.

**9.2 Privacy and Surveillance.** You must not use wallet, address, cluster, label or transaction analytics to identify, de-anonymise, profile, monitor, dox or take adverse action against any natural person, or in any manner that infringes any person's privacy or data-protection rights. Where you monitor addresses belonging to others, you are the controller of that processing and are responsible for having a lawful basis for it (Privacy Policy §2.2). Where you submit, upload or enter any personal data relating to another person into the Platform, the Assistant or any prompt, you warrant that you have a lawful basis to do so, and you must not submit special-category or sensitive personal data, government identifiers, credentials or payment card data.

**9.3 Impersonation.** You must not impersonate any person or entity, misrepresent your affiliation, or operate any account, username, profile, token, group, website or communication purporting to be Birdeye, Birdeye personnel or a Birdeye support channel.

**9.4 Undisclosed promotion.** Where you post about a token, protocol or project in which you hold a position, or for which you have received or expect compensation, you must disclose that interest clearly in the same post.

**9.5 Scams and phishing.** You must not post or distribute phishing links, malicious contract addresses, fake airdrops or token approvals, drainer contracts, counterfeit token listings, or links to any site designed to deceive Users.

**9.6 Unlawful and infringing content**. You must not post, upload, link to or distribute any content that is unlawful, that infringes or misappropriates any person's intellectual property, publicity or privacy rights, or that constitutes child sexual abuse material, non-consensual intimate imagery, or material promoting terrorism or self-harm. We may remove such content and report it to the competent authorities.

**9.7** **Eligibility.** You must satisfy the eligibility requirements in Section 1 of the Terms, including that you are an adult of the legal age of majority in your country or state of residence (whichever is higher), and you must not permit any person who is not eligible to use your User Account or Digital Wallet connection.

**9.8 Use of our name and marks.** You must not use the Birdeye Peak Trademarks or any confusingly similar sign, or state or imply any partnership, sponsorship, endorsement, certification, listing approval or affiliation with Birdeye, without our prior written consent. In particular, you must not describe any product, service, token or project as "powered by Birdeye", "verified by Birdeye", "audited by Birdeye", "listed by Birdeye" or similar unless we have agreed that description in writing.

## 10. PLATFORM AND SECURITY INTEGRITY

**10.1** You must not introduce any virus, worm, trojan, ransomware, drainer or other malicious code, or interfere with the integrity, availability, security or performance of the Platform.

**10.2** You must not conduct any denial-of-service, load, stress, penetration or vulnerability test against the Platform without our prior written authorisation under an agreed scope. Requests for authorisation, and any vulnerability report, should be sent to [support.peak@birdeye.so](mailto:support.peak@birdeye.so).

**10.3** You must not avoid, bypass, disable, reverse engineer or attempt to defeat any authentication, entitlement check, paywall, rate limit, content filter, geo-block or other technical or security measure.

**10.4** You must not probe, scan or test the vulnerability of any network or system, or breach or circumvent any security or authentication measure.

**10.5** You must not generate spam, dust or filler transactions, flood any RPC endpoint, mempool, indexer or data feed relied on by the Platform, or otherwise impose an unreasonable or disproportionate load on our infrastructure or that of our service providers.

**10.6** If you conduct security research or vulnerability testing, you must confine your testing to the systems, endpoints, environments and accounts authorised under Section 10.2 or designated as in scope under any disclosure programme we publish; you must not access, modify, exfiltrate, retain or disclose any User Content, User data or personal data, and on any inadvertent access you must cease testing immediately, notify us, and delete all copies; you must not degrade or disrupt the Platform, any Service or any other User's use of them, and must not use any denial-of-service, spam, social-engineering, physical-intrusion or supply-chain technique; you must report each finding to us promptly and in full, and provide such information and assistance as we reasonably request to reproduce and remediate it; and you must not disclose any finding publicly until we confirm it has been remediated or ninety (90) days have elapsed from your report, whichever is earlier. The Security Research Safe Harbour in Section 4J of the Terms sets out the protection available to you where all of these conditions are met.

**10.7** You must not create or maintain more than one User Account except with our consent, create any account using false, misleading or another person's details, or sell, buy, rent, share or transfer any User Account or its credentials. You must keep your credentials secure and must not permit any other person to use them.

**10.8** You must notify us at [support.peak@birdeye.so](mailto:support.peak@birdeye.so) without undue delay after becoming aware of any unauthorised access to or use of your User Account, credentials or Digital Wallet connection, and you must take reasonable steps to secure your access.

## 11. ADVERTISING INTEGRITY

**11.1** You must not generate invalid traffic or fraudulent engagement in respect of advertising on the Platform, including by clicking or causing impressions of your own or a client's advertising through automated means, incentivised clicks or any other artificial method.

**11.2** Where you advertise, sponsor or promote on the Platform, your advertising must be lawful, accurate and clearly identifiable as advertising. You must not make any financial promotion that you are not licensed, authorised or exempt to make, misrepresent any return, yield, risk, audit, endorsement or listing status, imply any Birdeye involvement contrary to Section 10.8, or direct advertising at any person who is not an eligible User.

## 12. REPORTING

**12.1** If you become aware of conduct that breaches this AUP, please contact us at [support.peak@birdeye.so](mailto:support.peak@birdeye.so). Reports are treated in confidence so far as reasonably practicable.

**12.2** We may investigate reports, and we may process account, usage, device and technical data for that purpose.

**12.3** We will not take adverse action against any User for making a report in good faith. You must not use the reporting channel to submit knowingly false, malicious, automated or bulk reports.

**12.4** Where we investigate a suspected breach of this AUP, you must cooperate reasonably with that investigation, and you must not delete, conceal or alter information that is relevant to it.

## 13. ENFORCEMENT

### 13.1 What we may do

Where we reasonably believe this AUP has been breached, or where necessary to investigate a suspected breach, we may take any of the following steps, in any combination and without prior notice. These steps are in addition to, and do not limit, our rights under Section 4A (Restrictions) and Section 14B (Termination) of the Terms:

1. issue a warning;
2. apply rate limiting, throttling, queueing or a delay to your requests;
3. reduce response length or model capability for the Assistant or any AI Feature;
4. temporarily suspend access to the Assistant, any AI Feature or any API Key, or reduce, reallocate or suspend Seats, quotas or Compute Unit allocations;
5. revoke or rotate API Keys;
6. remove, restrict or disable content, a username or a profile;
7. reset, adjust or withdraw points, tiers, statuses or Intangible Rewards;
8. suspend or terminate your access to all or part of the Platform, and terminate the Terms as between us; and
9. report the matter to law enforcement, a regulator or another competent authority.

### 13.2 Access to your Digital Wallet

Enforcement action under this AUP will not prevent you from accessing your self-custodial Digital Wallet or the Digital Assets held in it, unless we are legally required to act otherwise. We do not hold your keys and cannot freeze your Digital Assets.

### 13.3 No waiver; no obligation to act

Our failure or delay in enforcing any part of this AUP is not a waiver of it. We are not obliged to monitor for breaches, and the fact that conduct has not been actioned is not an indication that it is permitted.

### 13.4 Reinstatement and queries

If you believe enforcement action was taken in error, contact [support.peak@birdeye.so](mailto:support.peak@birdeye.so) within 30 days of the action setting out the position. We will review the matter and respond within a reasonable period, though we are not obliged to reinstate access. Where applicable law requires us to provide a statement of reasons or an internal complaint-handling mechanism, we will do so.

### 13.5 Proportionality

We will seek to take steps that are proportionate to the nature and seriousness of the suspected breach. Where we consider it practicable and lawful, and where the breach is neither serious nor persistent, we will give you notice and an opportunity to remedy before suspending or terminating your access. Nothing in this Section 13.5 limits Section 13.1 or our rights under the Terms.

## 14. CHANGES

We may update this AUP as the Platform and the law develop, in the manner set out in Section 13 (Amendments and Variations) of the Terms. The current version is always the one posted with the most recent "Last Updated" date. Changes apply prospectively only, from the date the updated AUP is posted, and do not apply retroactively to conduct occurring before that date. Your continued use of the Platform on or after that date constitutes acceptance of the updated AUP. Where a change is material, we will use reasonable efforts to notify you in advance.

## 15. GENERAL

**15.1 Severability.** If any provision of this AUP is held to be invalid or unenforceable, that provision is to be read down to the minimum extent necessary to make it valid or, if that is not possible, severed, and the remainder of this AUP continues in full force.

**15.2 Survival.** In addition to, and without limiting, the survival provisions of the Terms, Sections 5 (Data, Content and Intellectual Property), 6 (Birdeye Peak Data APIs), 9 (Conduct Towards Other People), 10 (Platform and Security Integrity), 12 (Reporting), 13 (Enforcement) and this Section 15 of this AUP survive any suspension or termination of your access to the Platform.

**15.3 No third-party rights.** This AUP confers no right or benefit on any person who is not a party to the Terms.

**15.4 Governing law and disputes.** This AUP is governed by the law that governs the Terms, and any dispute arising out of or in connection with this AUP is a dispute under the Terms and is to be resolved in accordance with the dispute resolution provisions of the Terms.
